Much change By Phillip Taylor MBE MUCH CHANGE IN THE LAW AND PRACTICE OF FAMILY LAWAn appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green ChambersAll family practitioners will welcome the new edition of this important work just published by the Law Society to cover “Family Law Protocol”. As Sir James Munby says, whilst most of the fundamentals remain unaltered, much has changed in the law and practice of family law. The new fourth edition of the Protocol sets out exactly what previous judicial commentators have said and that is the attempt to achieve resolution by means of ADR with court proceedings being the last resort.Yes, and that is how it should be because this current book sets out how the Protocol distils the important elements of practice and procedure, providing both clear and helpful guidance to family practitioners. As practitioners, then, we cannot do without these excellent texts from ‘The Law Society’ which set out, as far as we are concerned, what the official position is so there is no messing about with how we should approach our work. “Family Law Protocol” is a part of the Law Society Protocol series and describes itself well as giving us an “authoritative set of best practice guidelines”.They do and there are new chapters on forced marriage, domestic abuse and honour based violence and alternative pathways to parenthood which form part of the current legal agenda for 2015 with the new family court which has been created since the last edition appeared. The importance of this short work of 200 pages is the endorsement given by Munby, as President of the Family Division, to set out for all of us the standard by which members of the Law Society and Resolution are judged. And the appeal of the Protocol goes wider than that with the massive increase in unrepresented parties because of the folly of the legal aid cuts which will cost us all more in the long run because of bad administration. It is pointed out that the Law Society and its association with Resolution and other leading organisations, providers, interest groups and leading figures and users in this field of law broke new ground by introducing this ‘go-to text’ for family law practitioners in 2002 and we commend it today in its fourth edition. James Munby writes that it is an “invaluable good practice guide to all who work within the field of family law” and he is right- it does not disappoint! Thank you.The publication date is cited as 2015.
